   In no event shall Shaula, its employees, agents, representatives or officers be liable for any direct, indirect, special consequential, punitive or exemplary damages or any other damages of any kind, including but not limited to loss of use, loss of profits or damages resulting from lost data or business interruption, resulting from the use or inability to use this website and content whether based on warranty, contract, tort (including negligence) or any other legal theory, even if Shaula has been advised of the possibility of such damages. If any part of this limitation of liability is found to be invalid or unenforceable for any reason, then the aggregate liability of Shaula under such circumstances for liabilities that otherwise would have been limited shall not exceed one hundred ($100.00) dollars.

8. BY USING DiviDog, YOU ACKNOWLEDGE AND AGREE TO ALL THE TERMS BELOW:

   • DiviDog effortlessly divides pet food in the can into parts, but equal portions cannot be guaranteed. The size of the portion depends on the settling of the pet food in the can, the upside-down positioning of DiviDog by the user, and whether any angle is applied when pushing down the DiviDog container to insert the pet food can.
   • The food portion or division made by DiviDog is not a suggested or recommended meal size for your pet. You must follow the recommendations of your vet or licensed nutritionist for an appropriate meal size for your pet and adjust the food portions or divisions made by the DiviDog container accordingly
   • DiviDog may come with all possible faults and defects that could occur at various stages of manufacturing and the supply chain. DiviDog is sold by Shaula "AS-IS".By using DiviDog, you acknowledge that such faults and defects are unintentional and you waive liability and indemnification resulting from them
   • By using DiviDog, you acknowledge that the food you store in DiviDog is deemed safe for your pet by your vet. The microwaving time to heat the food, the duration of the dishwasher cycle, and the number of refrigeration days are all at your own discretion or in accordance with recommendations from your vet. You also acknowledge that Shaula has not provided any guidelines on how to handle your pet's food within the DiviDog container.
   • You acknowledge that your pet's food, when in contact with the DiviDog container made with Polypropylene (PP), is deemed safe to store, heat, and consume by your vet.
   • You acknowledge that you will exercise utmost caution when putting your fingers in the gaps provided to grip the pet food can. The edges of the gaps are sharp and may cut your fingers if not used as recommended. Do not twist the pet food can by placing your fingers in the gaps provided to grip the bottom. If the gaps are too small or cannot easily accommodate your fingers to grip the bottom of the pet food can, do not force-fit your fingers onto the pet food can bottom, and do not use the DiviDog container.
   • DiviDog works best with pate-form pet food in generally available pet food cans. If the DiviDog container is used for any pet food type or form not in pete form, it is solely at the user's discretion. DiviDog strictly recommends against using it for non-pate form pet food.
   • DiviDog makes no suggestions or claims regarding the shelf life of your pet food stored in the DiviDog container. You acknowledge that you will follow the recommendations of your vet or pet food manufacturer guidelines for the suitable shelf life of your pet's food in the DiviDog container.

9. REASONABLENESS:
   By using this website, you agree that the exclusions and limitations of liability set out in this website disclaimer are reasonable. If you do not think they are reasonable, you must not use this website.

You agree that any legal action or proceeding concerning the terms of this Agreement or the parties’ obligations hereunder shall be brought exclusively in a federal or state court of competent jurisdiction in the State of Rhode Island.

22. ASSIGNMENT:
    Shaula may transfer, subcontract or assign their rights and obligations under these terms and conditions without notifying you or obtaining your consent.
